Cancer Presumption (HB 1768) |

With the passing of HB 1768(Cancer Presumption) in late June by a margin of 193 to 4, the PPFFA has worked diligently to try to get it passed in the Senate. An action plan was developed and the PPFFA has been following it through. We have a real oppurtunity to pass this legislation this year, but it will not be easy. There are many factors that are outside the control of the PPFFA that may come into play.
As of this writing it is in the Senate Labor and Industry Committee and it must make it out of there. At this time, there isn’t a L and I Committee meeting scheduled which will mean the death of this Bill. I have heard from some sources inside Harrisburg that they may possibly meet on Sept 23, but there is still no official announcement.
If it makes it out of Labor and Industry, it will then go the Senate Appropriations Committee and the whole process starts over again. After passing through Appropriations it will go to the Senate for a floor vote.
The Senate has scheduled only 9 session days from now until election day on Nov. 4 and they have said they do not plan to meet post election. So our time is limited.
- Factors that are in our favor:
1) We have received Bi-Partisan support.
2) We have Senate leadership on board and this may help push Sen. Gordner(Chair of Labor and Industry) to hold a committee meeeting.
3) Pa. League of Cities is remaining neutral on this issue(In its original form, they opposed it because of retroactive provisions that have been removed).
4) The Pa. Fire and Emergency Services Institute is on board and is supporting this bill.
- Factors against us:
1) Time.
2) Do not know where the Governor stands on the issue.
3) The Insurance Lobby may oppose this legislation(The Insurance Lobby wields a lot of power in Harrisburg).
4) If any amendments happen in the Senate it has to return to the House to be passed again with Amendments.
What can you do? You can contact your Senator and ask them to support HB 1768.
